ACTRA Terms of Service
1. General provisions
These Terms of Service govern the use of ACTRA, including the hosted web application, local application, website, related APIs, learning features, AI-assisted features, Premium access, and other available service functionality.
By creating an account, signing in, purchasing Premium access, or continuing to use ACTRA, the user confirms that they have read and accepted these Terms, the Privacy Policy, and the Refund Policy.
If the user does not agree with these documents, the user must not use ACTRA.
2. Service description
ACTRA is a digital learning and practice service. It helps users create and organize learning materials, complete tasks, use reference and AI-assisted features, track progress, and work with user-created or service-available educational content.
The exact feature set may depend on the application version, account settings, active plan, available integrations, deployment mode, and technical configuration.
3. Eligibility
Users who are at least 16 years old may use ACTRA independently if they have the legal capacity and permissions required under applicable law.
Users under 16 may use ACTRA only with consent and supervision from a parent or guardian, or through an educational organization, teacher, employer, or other authorized representative that is lawfully entitled to provide or manage such consent.
Paid access, payment obligations, and billing-related actions must be performed by an adult payer, legal representative, or another person lawfully authorized to make the purchase. If applicable law requires additional consent or capacity for digital services, the user is responsible for obtaining it before using ACTRA.
4. Account and security
Some features may require an account or profile. The user agrees to provide accurate and current information, keep login credentials secure, and not share account access with third parties.
The user is responsible for activity performed through their account unless unauthorized access is proven and reported in a timely manner.
5. Acceptable use
The user must not use ACTRA to violate law, infringe third-party rights, upload malicious code or prohibited content, bypass access controls, interfere with service operation, or attempt unauthorized access to accounts, infrastructure, data, APIs, or sessions.
The user must not use AI-assisted features with content they are not entitled to process or submit.
The user must not upload personal data, medical information, or other sensitive information about third parties to public, shared, or other user-accessible areas of ACTRA without a proper legal basis, including any required consents, permissions, and de-identification required by applicable law.
A user working with medical images, scans, reports, discharge summaries, or other clinical materials must remove or properly mask patient identifiers and other information that can directly or indirectly identify a person before uploading such materials for learning, demonstration, or publication purposes, unless applicable law or obtained consents permit otherwise.
6. User content
The user retains rights to materials, answers, files, text, settings, and other content uploaded or created by the user, subject to applicable law and any separate agreement.
The user grants ACTRA a free, non-exclusive, worldwide license to reproduce, store, transmit, display, process, and analyze user content solely to the extent necessary to provide, secure, support, maintain, and improve ACTRA, including synchronization, backup, diagnostics, support, and user-initiated AI-assisted functions.
This license does not transfer ownership of user content to ACTRA and ends when the content is deleted or the account is closed, except where continued limited retention is required by law, security, backup integrity, dispute resolution, or legitimate operational needs described in the Privacy Policy.
The user represents and warrants that they have all necessary rights, licenses, permissions, and lawful bases to upload, store, process, analyze, publish, and otherwise use their content in ACTRA, including, where necessary, consent from rightsholders, patients, employers, educational organizations, or other authorized persons.
The user represents and warrants that their content does not infringe copyright or neighboring rights, trademark rights, moral rights, confidentiality rights, medical secrecy, personal data protection rights, or any other third-party rights, and does not violate applicable law.
The user is fully and solely responsible for their content and the consequences of uploading, storing, publishing, distributing, submitting, analyzing, and using it through ACTRA, including responsibility toward third parties.
7. Content moderation, removal, and complaints
ACTRA is not required to pre-screen user content, does not automatically endorse user content, and is not responsible for user content toward third parties to the maximum extent permitted by applicable law.
ACTRA may at any time and without prior notice hide, remove, restrict access to user content, individual materials, collections, publications, and archive copies to the technically available extent, and may restrict, suspend, or block access to an account if there are grounds to believe that the content violates these Terms, law, or third-party rights, if a complaint is received from an alleged rightsholder or data subject, or if the content creates a technical, legal, security, or reputational risk for ACTRA or other users.
Removal, hiding, restriction of access to content, or account blocking on these grounds does not require ACTRA to refund Premium access payments, except where mandatory law or the Refund Policy expressly requires otherwise.
If a person believes that content available in ACTRA infringes their rights, they may send a notice to actrafb@proton.me. The notice should preferably include a link or other information identifying the disputed material, a description of the alleged infringement and the relevant rights, contact details, and confirmation of authority if the notice is submitted by a representative.
ACTRA will review such notices within a reasonable time and may temporarily restrict access to the disputed content while reviewing the matter. ACTRA may request additional information from the complainant or from the user who uploaded the content.
8. AI-assisted features and third-party providers
ACTRA may include features that use artificial intelligence models and third-party AI providers described in the Privacy Policy.
When AI-assisted features are used, relevant prompts, materials, instructions, task metadata, responses, and technical information may be transmitted to the selected or configured AI provider to perform the requested function.
AI output may contain errors, omissions, incomplete information, or unsuitable recommendations. The user is responsible for reviewing AI output before relying on it or using it for important decisions.
External providers may apply their own terms and data processing policies.
9. Premium access, prices, and payment
ACTRA Premium is paid digital access for a fixed period. Available prices are shown on the public Pricing page and inside the application where Premium is offered.
Premium access does not include the sale or delivery of physical goods. After payment is confirmed, Premium access is activated digitally for the user's account for the selected period.
Payments may be processed by a third-party payment provider. The provider may apply its own checkout, payment, tax, compliance, and security rules.
10. Refunds
Refund requests are handled according to the Refund Policy, the circumstances of the purchase, applicable consumer protection law, and payment provider rules.
Refunds are available only in the cases described in the Refund Policy or where mandatory law requires a refund.
If a refund is approved, the related Premium access may be cancelled or adjusted.
11. Availability and changes
ACTRA is provided on an "as is" and "as available" basis. The service may be updated, changed, limited, interrupted, or discontinued in whole or in part for technical, security, operational, legal, or product reasons.
ACTRA does not guarantee uninterrupted, error-free, or delay-free operation.
12. Intellectual property
Unless stated otherwise, ACTRA, its interface, code, structure, design, documentation, logos, and other service elements belong to ACTRA or are used under lawful permissions.
The user may not copy, distribute, modify, reverse engineer, or create derivative works from service elements except as permitted by law or by the normal functionality of ACTRA.
13. Suspension and termination
ACTRA may restrict, suspend, or terminate access if the user violates these Terms, creates security or operational risk, uses the service unlawfully, or if such action is required by law or infrastructure provider obligations.
If access is suspended or terminated because of a violation of these Terms, paid amounts for the affected Premium period are not refunded, except where mandatory law requires otherwise.
The user may stop using ACTRA at any time. Account or data deletion may be available within the service or by contacting support, subject to applicable law and technical limitations.
14. Disclaimer and limitation of liability
To the maximum extent permitted by applicable law, ACTRA disclaims warranties of merchantability, fitness for a particular purpose, uninterrupted operation, error-free results, and complete data preservation beyond reasonable security measures.
To the maximum extent permitted by applicable law, ACTRA is not liable for indirect damages, lost profits, loss of business reputation, data loss, interruptions, AI output errors, or consequences of third-party integrations.
For users on a free plan, ACTRA's aggregate liability is limited to zero to the maximum extent permitted by law. For users who paid for Premium access, ACTRA's aggregate liability is limited to the amount the user actually paid for ACTRA during the 12 months preceding the event giving rise to the claim, unless mandatory law requires a higher amount.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
15. Changes to these Terms
ACTRA may update these Terms. A new version becomes effective from the date indicated in the document unless stated otherwise.
For material changes, ACTRA will notify users at least 14 days before the effective date through the service interface and, where an email address is available, by email. Continued use of ACTRA after the effective date may require renewed acceptance.
16. Applicable law and disputes
These Terms are governed by the laws of Ukraine, except where mandatory consumer protection rules of another jurisdiction apply and cannot be waived.
Disputes are submitted to the competent court at the location of the ACTRA rightsholder or operator, unless mandatory law grants the user another venue.
If any provision is found invalid or unenforceable, the remaining provisions remain in force.
